I got my bank statement today. All month I had been having trouble with my bank because they charged me a fee I disagreed with and when I questioned the manager on it, he spent ten minutes telling me how stupid I was so I got upset and left.
Well. After that he started holding all of my deposits for extra time, to prove that he could. And it was perfectly legal. The fine print is a bitch these days.

So by the time the end of my statement the bank had taken nearly a whole paycheck in fines and fees. And it's perfectly legal. I've been on the phone all day trying to get someone in the bank to help me get this corrected and while they did eventually stop calling me stupid, or treating as if I were, no one was willing to help me. They all kept explaining that the first fine, the one that started it all was perfectly legit and here's why...

I used my debit card.

That's it. That's why. Seriously.

When you use your debit card they can hold as much as they want from your account until the merchant takes what YOU authorized on the moment of purchase. Oh, and they can take as long as they want to do that. So your money that you THINK you have, you DON'T have for an undisclosed amount of time. And each merchant? Is different. There is no set amount of time or amount of held monies. No standard by which to judge your spending or purchases.

I know. I know. It's MY fault for living paycheck to paycheck. People who keep large balances in their checking accounts don't have this problem. This is my fault for being one of those nasty little POOR people.

So I said "Oh. I see. You made legal a set of rules that allows you to take as many fees as you can get. I understand."

"No. That is not it." She says, I can HEAR her puffing up and rolling her eyes.

""Oh please." Says I. "Ever since you changed over to a bank instead of a savings and loan, there have been nothing BUT these kinds of tricks. All of you banks are the same. You push and you push these cards that you KNOW will allow you to take more and more. Well I'm NOT going to understand. I am NOT going to agree with it and I AM going to lodge a complaint with the Better Business Bureau because ... IT. IS. WRONG."

Oh. And at one point.... I called debit cards Teh Debbil. I said it just that way, though I really don't think she caught it.

Ive been burned by that debit card rule more then once, and it is frustrating every single time.

While i havent found a perect solution, i opened another account at a diferent bank, and i split my direct deposit between the two. I use one for my debit purchases (or try to at least) and another for my bills and such.

While not perfect yet, im hoping it will streamline eventually.

    Banks are teh evil.

At one point I had two checks go through my account at the same time that a direct deposit was scheduled to go into the account. instead of taking the deposit, and then having more then enough to cover the checks, they declined both checks, charged em 40 bucks for each check, then credited my deposit. Then when the checks came back, they held them for two extra days at which point my balance had dropped to the point that when they charged me a "holding fee" for the checks, there wasn't enough to cover one and they charged me another nsf fee, and then decided to honor it and charge me an OVERDRAFT fee.

I know my fault for trying to cut it so close to pay days, but thats why i closed my account with bank of america. i refuse to do business with them of my own volition ever again. EVER. That and be sparing with the checks out there.

I would be seriously pissed off about that. It is has been a problem over here, banks do seem to be a law unto themselves the world over. I hope you get some satisfaction from the complaint process.

No satisfaction. The BBB is a toothless organisation at best. But it felt good to say.

BBB is worthless. They have absolutely no teeth.

STop using your debit card. Pay cash. Its the only way to stop it. I dont havea debit card.

Or find a new bank? because I remember when you were happy with this one...
  • LadyGamer said on Nov 19, 2007....

This one was a savings and loan when I signed on with them. They recently changed formats to being a Bank.

The only solution I see is to cease doing business there. I don't have spare paychecks lying around. The problem with THAT is that not many banks WILL do business with ME because of the identity fraud.

Huh. I've never even heard of the debit card rule, although a co-worker got burned by the fact that authorizing direct deposit also authorizes the depositor to remove the same amount of money after depositing it.

Umm. The only bank that I was ever burned by was actually a Credit Union. I've never been with a Savings and Loan.

But I do hate how overdrafts tend to snowball into hundreds of dollars.

Oh, and I live paycheck-to-paycheck as well. Isn't that the normal situation for most folks? In fact, I still find myself relying on credit cards a week before my next paycheck.

    *sigh*

unfortunately, for the average person around the world, we all do live paycheck to paycheck, because wages have lowered overall, and costs have risen overall, so there is no money left over to save. so the banks have to stuff their coffers somehow. i don't know how many people have noticed, but bank charges of these types have risen from $10 to $35 or more in just 5 years. it's a cash cow for the bank, and they have a prescribed script for everyone that complains to politely say, 'gotcha, you're screwed!' but as we all know, we're in a cycle where the rich are getting richer, and the poor are getting poorer. hopefully that'll shift when the democrats take office in '08.

I refuse to use bank for more than a free check issue service. I keep all my cash in a laundry bag in my closet. All twenties too. A big bag. All banks allow you one free check per day so take advantage of it and screw giving them all the dough for a measly 1-1/2% interest. What an insult. It was a minimum of 5-1/4% when I was growing up.

  • TinSoldier said on Nov 19, 2007....
    Interest? WTF is that?

I don't get any interest on my checking account. But I don't pay anything for it either.
  • sheltercrow said on Nov 19, 2007....

I once had $36,000 in the bank and they did nice and gave me 2-1/4%.

  • TinSoldier said on Nov 19, 2007....
Ah. See, I don't think that I've ever had $36,000.

Not in savings, not in checking, not in 401K.

BBB can only bring an organizations rep down...it has NO other purpose.

as for banks. that SUCKS. and yeah....i've been burned by it too.

i bounced a check for 3 bucks once.....

ended up with $900 in fees.

my insurance company held a check for too long (legally) ....and then tried to electronically charge it through my bank.
every time it hit my account another $50 in fees was added........
every time it hit my account and came back declined they would try it again to make sure......
they hit my account with that $400 dollar check TEN times.

i was going to one of those "no fee" banks at the time.....all that means is they don't charge you to use your debit card.....it didn't apply to overdraft fees.

and because it was a "no fee" bank.....they said they couldn't remove ANY of the charges because that was their only form of revenue.

my baby daughter at the time even pulled down my shirt neck and i accidentally gave the bank manager a full flash. and he STILL wouldn't do anything.

    hmmmph.

I've had similar problems with trying to close out accounts...a vicious cycle of "fees."

Like my hubby says,  "Computers are only as smart at the people running them."
