Some people on SC have argued that the President shouldn't have to follow the law. I guess they aren't familiar with history so here is a modern example of the dangers.

Pakistan’s President Pervez Musharraf has declared emergency rule and suspended the country’s constitution.

Troops have been deployed inside state-run TV and radio stations, while independent channels have gone off air. Chief Justice Iftikhar Chaudhry, who condemned the moves, has reportedly been sacked and is being confined to the Supreme Court with 10 other judges.

It comes as the court was due to rule on the legality of Gen Musharraf’s re-election victory in October. Read more…

i was reading about it this morning.

here's what really scares me, though: one year in the future, we'll be waiting to learn who will be the new president. i am increasingly concerned that bush will cite some terrorist threat as a pretext to seizing dictatorial control. and some people will be more than happy to let that happen.

I highly doubt it.  The only way I see us getting more Bush is if something really horrendous were to occur.  Much worse than 9/11 and yeah I think a lot of people wouldn't argue that if we just got nuked and lost 10k citizens, or had a massive bio attack of some sort that maybe the election should be pushed until it's safe to go to the polls.

That said since both of those are Tom Clancy level threats you can rest assured that Mrs. Clinton will be president soon.

It isn't about Bush, it's about setting the precedent that Presidents can ignore the law when they don't like it. Where will this precedent lead in the future?

It might be worth remembering here that Rudy Giuliani did his damnedest to forestall the mayoral elections during the fall of 2001 to extend his time in the office (he was going to have to leave office due to term limits).

Since Bush has acted as if laws do not apply to him, I see no reason whatsoever to doubt that he might try to do something like this in order to stay in office. A plausible example would be an attack on Iran that leads to armed conflict with Iran. Bush could conceivably then declare a state of emergency and keep himself in power.

Such prospects are, as Sean said, worthy of a Tom Clancy thriller - but given the actions of this administration to date, I'm not so sure that they are solely the province of fiction.

I was watching the news this morning and guess what justifications musharraf gave? Terrorism and activist judges. Sounds familiar doesn't it.

that's the point i was trying (apparently unsuccessfully) to make in my previous comment. :>
