" So in a move that Kokesh, other veterans and several attorneys find unusual, the Marine Corps has ordered him to appear at a hearing to consider throwing him out - even though he's already out - with an "other than honorable" discharge."

I guess that's why USMC stands for U Signed the Motherfuckin Contract.  I myself am in the IRR.  We are still subject to the UCMJ and all that kind of crap but I can't imagine being called up on it. On the bright side he'll become such a symbol if they go through with this that it won't even be funny.

I guess we're only fighting for democracy in Iraq.

SR: I'm no longer an inactive reservist, but I'm pretty sure that OTH's aren't either. That would not make his actions subject to the UCMJ, Please correct me if I'm wrong, but I believe that when you're out you're out.
bloc: (in case you did not know) an OTH discharge in the Marine corp. is a dismissal based on misdemeanor charges.  The  only explanation that I can think of, for charging him further would be if new information has been attained, That the Marine corp. thinks meets "dishonorable discharge" criteria. (felony)
That would be a pretty rare occurrence. You're probably right on, they're head hunting him.

My point was: That I'm pretty sure that the IRR connection is inaccurate.
  • SeanRenaud said on Jun 03, 2007....
While you are in the IRR you're not out though, your innactive.  They can recall you for pretty much any reason they want and then when they re-release you give you the lower.  It never happens and theys guys are definitely being douches.
  • CalmDown said on Jun 04, 2007....
SR: True, these guys are getting the shit end of the stick. But in defense of the whole IRR/enlistment connection: everyone that has ever(in the past few decades) joined the military, has this explained to them before signing. Only extended active duty will shorten your IRR. It's not a back door draft, if you know about it, and have the option to not sign on.
  • SeanRenaud said on Jun 04, 2007....
I'm not arguing that fact, though to be fair they kinda gloss over it with a, don't worry about it it doesn't/won't happen.  If you sign up now you will actually use up some of it before (like I spent a year in the poolie program so I did my first year of IRR before joining officially).

It might be a backdoor draft of sorts but who cares, before you start calling random joe I'd rather you call people who have some idea of what they are doing.  I mean if we get to the point of a draft (I would hope) that the situation would be pretty damned dire.

    I concur!
  • bloc said on Jun 04, 2007....
but is it fair to people if you stop loss them after their 8 years? Are they stop lossing people after their IRR contract is up?
  • SeanRenaud said on Jun 04, 2007....
Stop loss is different from recall.  No it isn't fair if you recall somebody after their 8, was this guy's 8 up?
  • bloc said on Jun 04, 2007....
i wasn't asking about this guy. His 8 weren't up, but they are only recalling him to try to give him a worse discharge :/

I was just expanding the discussion on back door drafts.
  • CalmDown said on Jun 04, 2007....
While I was still in, during operations Desert Shield/Storm: They froze EAS's (stopping anyone from getting out regardless of IRR time left) I considered this very unfair, although it did not effect me.
Recalling someone, simply to  upgrade his charges and downgrade his discharge, just plain stinks. Attacking Sheehan or O'donnell for their radical anti war views, although a bit sinister, may be necessary. But  returning Marines (combat veterans) should be able to voice any opinion on the subject!
Was John Kerry called back to active duty so that his discharge could be reevaluated, after he bad mouthed the Navy and the war in the 70's? Or are Enlisted personnel held to a higher standard?
