my one co-worker is being worked to the brim - he now was told he must work friday (which for us is a public holiday) - saturday + sunday + monday (another public holiday for us). heres the catch - they are not paying him any over time. i found out that in south african labour law legislation it strictly states that if one should work on a sunday, he should be paid 2x his hourly rate for everyhour worked. same goes for public holidays. also that these days of work are voluntary.
 
his direct head is making it seem like he has no choice and aparently no life iether. i couldnt believe that our company has been doing this for years without anyone catching on or speaking out?!! no one wants to throw stones or educate themselves with labour law - rather eat shit or get fired (thats the attitude) - am i wrong when i say that we should stand up for our rights? or atleast educate ourselves on them???? no one has the balls here to tell them sorry i cant work on this public holiday, ive got plans - they dont have to say yes. its supposed to be voluntary. why are so many grown ppl not standing up and speaking out?
 
or am i just stupid and is there some hidden rule that i didnt know about? that ppl think they can lose their jobs or get in shit if they lay down the law- literally? how come so many companies think they are above the law? and howcome so many employees let them?
 
its so frustrating for i could just shit in my pants right now!

    LMari, does your co have a human resources dept?  If I were him I would put in a grievance to the HR dept. that is usually the best way to go.

    thing is, companies (most) know how to dodge bullets and they know before they even hire to you - how to get out of a sticky situation.

    i know from experience. i was called 'fish 'n chips' (bcos i have a portuguese surname) - 'pet'- 'shit' - by my boss. at first i laughed it off as a joke. then she wouldnt stop it and she would do it infront of clients and humiliate me big time. when i complained to the big boss - i got a letter the next day saying my position was infact a temporary one, and i would need to leave the company in 4 days time. so any demfamatory claims didnt matter as i was leaving anyway. there wasnt a thing in i hell that i could do about it. never mind that it was a law firm i was working in! so there i stood up for myself being demfamed and humiliated by my boss. and i get kicked on my arse!?

    same thing here - if they complain about the public holiday thing- yes they might get what is legally set out for them- but their lives at work would be made a living hell. the same thing happened to a co-worker of mine- he laid a claim of racism, and they doubled his monthly target. he of course couldnt reach the sales - so he was eventually fired.

    so what do we do? do we open our mouths - and get bitten. or do we eat shit and keep our jobs? whats the fucken point of laws if companies are above them? really it makes me sick. i was just wondering if i was naive or arrogant in thinking one could stand up for their rights and live to tell the tale?

    Lmari, can you call anonymously to the labor division with your government for them to do an investigation of their own?  Better yet, can you call a news station anonymously and ask them to do a segment about this?  In our local paper, we can call in or write in and rant a short rant about anything and they print it in a special section. 
     
    This is just horrible that there's nothing anyone can do!  I can't believe you ended up getting fired...from a law firm!!!!!  I'm sorry that your co-worker has to go through all of this too.  It's sad!

    daily - any departement that the government is incharge of in south africa is up to shit. would take months to get anything done. its realy pathetic here. and at the end u ask yourself is it all really worth it? months of papers and claims and evidence and complaints and procedures - it would probably take these poor guys just under a year to sort out anything. our system is horse shit and good for nothing. the only way you get anything here is if you have tons of bux and tons of time.
