In their current form they criminalize puberty.  Read here for more.

I've been saying we should lower the legal age to 16 at the oldest and probably 14 or wherever the majority of individuals are hitting puberty for a while.  But of course I don't have a daughter which makes my points entirely invalid.

I rather assume that daughters/sisters are much like parents.  We would muchly prefer to believe that they never had or have sex and that we (and all of our sibblings, neices and nephews and Grandchildren) were the products of immaculate conception.  Often times repeatedly.

That was dramatic, and the article assumed a lot. Funny how there weren't any pictures of females on there.

When I was 14, an 18 year old had sex with me for the first time. I regret it, but I looked up to him so much. He was older and so cool to me. I couldn't believe he really liked me...that relationship quickly turned abusive. I am still shocked at the number of situations I found myself in that I felt were sexually inappropriate over the years. Married men well on there way to 30 would hit on me when I was as young as 16 or 17, people who knew me since I was 12.

Older kids understand the influence they have on those who are younger. I know this is true because it wasn't that long ago that I was 18. I don't know that the punishments should be any less severe. I think they should probably be dealt with on more of a case-by-case basis. I'm not the kind of person who would take a problem like that to the police because I consented to what happened, but that doesn't make it right. I see that now...at 21.

talk to me about it when you have a 15 yr old daughter dating an 18 year old boy.

I'm not suggesting that I want 18 year olds going out with 15 year olds, but should an 18 year old with raging hormones be stuck on a sex offender registry for hte rest of his life? Should he not be allowed to live within 1000 yards of a school or park for the rest of his life? Should his picture be on the internet for all to see for the rest of his life in a sex offender registry?

Also note that the peak is around 15 years old, not 18 years old. I don't think we should have a lifetime penalty for puberty.

I realized that I haven't be clear with how I feel. My problem with these laws is the severity of the punishment which is lifelong.

From the article, "Today, it has been criminalized, and criminalized in a way far exceeding crimes of violence. A youth who has sex with another youth, even if voluntary, could well face legal sentences far worse than if they had killed their friend"

"Every so often he will be required to visit the police and report to them. They may show up at his home anytime they want and demand to inspect it. He could be banned from social networking websites, or from the Internet completely.

" In jurisdiction after jurisdiction this “offender” will find that most of the community is zoned off limits to him. He can’t live too close to a school, too close to a park, too close to a bus stop, too close to…., the list is almost endless and growing all the time.

If you child grows up to have a family, a normal relationship will be forbidden. He may well be banned from all activities at his children’s school. They may be in a play; he won’t be allowed to watch it. If the kids play on a sport’s team, their father won’t be allowed to attend. Ditto for Little League. Forget having friends over for a birthday party. Dad is a pariah until he dies and his children, and his wife, will be forced to endure the torture with him."

Couldn't spare the time to scan for data.
Do we know how many and which states have exceptions for close-age relationships?

Two "kids" have relations when one is 15 and 364 days and has birthday sex with the 17 year old partner are really one year apart.  I understand some states call this statutory rape.  Ridiculous.

I'm curious how many juries refuse to convict.

  • SeanRenaud said on Sep 27, 2009....
I imagine very few.  We aren't taught to refuse to convict.  We are taught to look objectively at the case and see not if what they did should be a crime but if what they did fit the legal definition of what the prosecutor is claiming.  It seems like every few months I hear about a jury who didn't want to send a man to jail but felt they didn't have an option.

Interesting subject.  I have a teenage daughter and an older son.  The guy that wrote this article is pathetic.  If he gets moved to tears by a bunch photographs of kids branded sexual offenders by an outdated system what does he do when pictures of starving children in the Sudan come up?

He does raise a complete outrage and a system that seriously needs reform.  There should be a specific difference between actual sex offenders and kids caught playing petty-fingers or even voluntary sex.  Right now some pervert in his 40's (like Polanski) taking advantage of a 14 year old girl is the same as a 16 year old have sex with a 14 year old and that is appalling.  Until there is reform there should be a lot more education.  Kids should know if they have sex it is a crime and they will be arrested for it (as outrageous as that is.)

Not outrageous at all.  For a Republican.

I see that bloc and/or his lapdog had my comments erased. I'll simply unsubscribe from this post now and allow you to continue to wag your wieners at the under-schooled or at least the under-aged.

I don't remember it, but I have a clear policy about staying on subject.

Whatever. The "unsubscribe" obviously isn't working. I'll gladly try again...
