Kelly-First of all you are wrong on that last post because even the memos that President Obama released substantiated the fact our waterboarding brought very valuable information.
But look at this way in regards to waterboarding:
#1-Intent.
#2-The definition of torture.
1-To prove torture you have to prove it was a persons specific intention to torture. If it was our specific intention to torture people why waterboard? Why not chop off fingers? Why not use electricity?
2-We have to have a definition because there is a remedy for torture victims which is usually a sum of money. To prevent fraud there is a clear definition and this definition states in order to prove torture the actions have to rise to the level of extreme pain and suffering.
Our use of waterboarding with the monitoring of the detainees during the process, the fact the memos say our waterboarding causes no pain, the limits and safeguards pointed out in the memos shows it was not our intention and we certainly didn't cause extreme pain and suffering.
Can someone use waterboarding to inflict extreme pain and suffering? Yes. Did we? No.
