  Yeah that was definitely not a nice thing to do, very crude, and very disturbing for her family.  He definitely should have gotten something more than a slap on the wrist.  The other lesson for this, don't take those kind of photos or get that sort of exposure unless you're prepared for it and perhaps have discussed it with anybody who might see if it would leak out, so it wouldn't have been so shocking.  It still wouldn't excuse the invasion of privacy by any means, but at least it would have taken some of the sting out of it.

  Me the pictures were taken in their home doing a time that they loved each other, and now that they are getting a divorce he decides to post them on the web for her family to see. He is wrong.

  The fact that she took those pics for HIM (not for the world to see) is not the behavior to be condemned here.
  People can do whatever they want in their privacy if they are adult and consensual. Even more if they are in a relationship that implies trust and love.

  I don't care go how broken his heart might have been ..he shouldn't ever shown those pics to anybody......specially to their families.

  Ginger that is exactly how I feel, The pictures was taken by him for them to enjoy doing a time that they were in love, and like you say nothing is wrong with that.
  
  When you take pictures like that you never know where they are going to end up and this is a prime example of that. he is a real AH.

  20 days is nothing! And to think the woman will be traumatized for the rest of her life.....every time she walks into a room fully clothed, she'll always feel naked...even worse than naked. How can she look her family in the eyes again? What he did is something that can NEVER be taken back. And I betcha those pictures are going to be attached to some email forwards...once something is on the web there is never ever containing it.

  clv is really on to something there. letting someone take nude pictures of you, no matter the relationship, opens you up to the possibility that if the relationship ends, they'll end up on the internet. right or wrong, there they are. and to further exacerbate the situation, reporting the story in the media will cause thousands, if not millions, to go hunting for those pictures and posting them all over. they won't just stay on a website created by the guy and linked to her family, they'll be all over, forever.

  When I read your report ms. I was instantly surprised the husband got anything at all.  I agree it is extreme and emotional rape, no less.  But the justice system has hardly caught up with the capable crimes on the internet...so I am surprised a crime was charged, let alone conviction.  I admit I'm not up-to-date on my law, but I know in the past this crime would have gone no where in the legal system.
   
  I admit I have had photos taken of me...at 47 I looked so fantastic I was proud of my body...got a belly piercing and everything...Frankly, I WANTED to memorialize it, just in case things took a turn south.  I was on a sail boat with a long term boyfriend...I felt fantastic, it was a good summer...I had peace in my heart for a period.  Anyway, I am at risk for the same type of thing, obviously.  When I did this I had no reservations, and had my eyes wide open...knowing the risks.
   
  Luckily I am not running for office.
   
  However, my attitude (if caught) is a little different.  First, I could care less what my family thinks, and second...yeeha!  Don't I look great!!!!
   
  (course, this last year has taken it's toll...sigh.  (I'd be less likely to pose this summer).
   
  I guess I'll have to stay on the good side of the now exboyfriend...but, I just can't imagine him doing such a thing.  And, if he did...his bad.  My favor.

  fraggle...To where were they mailed?  And what are the damages?  Usually it is about the damages a person suffers and emotional (or punitive damages) isn't allowed or entered into the picture until the actual damages have been determined).
   
  For example.  A sends nude photos of B to B's boss, and B's boss fires her.  Simple, actual damages are proven...but (there is still a hurdle)...B has to prove she was fired for the photos.  This is often difficult by itself. 
   
  Assuming the case is an open and shut one, the actual damages are proven, she would get her wages and then punitive damages on top of that.  Punitive damages are usually far more than the actual damage awards.
   
  Or...
   
  A sends nude photos of B to B's boss, and he shakes his head and shrugs...the whole story goes no where.  A had published these photos (or allowed them to be taken) so it is not actionable.  She is embarrassed, humiliated even...but...
   
  The truth is not actionable.  We cannot even sue for the truth about ourselves being revealed.
   
  However, if the photos were done in private, and the privacy was broken causing the actual damages such as being fired, losing money, house, and home, or kids, etc...then...and usually only then...is it cause for a law suit where actual damages would be determined first, then the punitive (emotional) damages.
   
  Cripes, even if the photos are sent to a newspaper, unless B can prove A cost him or her money or some kind of extremity...it won't fly in court.
   
  I still don't get the criminal part of this case at all.  But every country and state experience different criminal codes...so who the hell knows.

  Travelr I think that you are really taking a chance when you let someone take nude pictures of you, he is angry and what was for his eyes only he is willing to put it out there for the whole world to see.

  I guess the intent is bad but who is hurt most is the man for the woman walk out on him.
  She need to be remind of the happy moment that might be what the man intent to do but the writer and the judge think other wise.

  the charge wasn't for the pictures, it was for hacking her email account. when someone lets you take pictures of them, they become your property and you can do what you want with them, that's how the paperazzi can exist. but email accounts are considered private property and it's illegal to gain unautherized access to them.

  I think we must look at the root cause of the whole problem. It is interesting to see how temper flares and gender takes side. Give you and illustration of Fire started without heat, fuel and oxygen is this possible? Yes law  at times could be faulty , I have seen it  in my lifetime , I have witness alot of faulty judgement that shocks the world.  And this happen in ancient time too. Even the finest Roman court could not save Jesus. Common laws are born from Romans court. Please look at Root cause , not the symptom or effects . That man is not guilty.
