An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

Roger Barnett 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.

His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.

Trial continues Monday in the federal lawsuit, which seeks $32 million in actual and punitive damages for civil rights violations, the infliction of emotional distress and other crimes. Also named are Mr. Barnett's wife, Barbara, his brother, Donald, and Larry Dever, sheriff in Cochise County, Ariz., where the Barnetts live. The civil trial is expected to continue until Friday.

The lawsuit is based on a March 7, 2004, incident in a dry wash on the 22,000-acre ranch, when he approached a group of illegal immigrants while carrying a gun and accompanied by a large dog.

Attorneys for the immigrants - five women and 11 men who were trying to cross illegally into the United States - have accused Mr. Barnett of holding the group captive at gunpoint, threatening to turn his dog loose on them and saying he would shoot anyone who tried to escape.

The immigrants are represented at trial by the Mexican American Legal Defense and Educational Fund (MALDEF), which also charged that Sheriff Dever did nothing to prevent Mr. Barnett from holding their clients at "gunpoint, yelling obscenities at them and kicking one of the women."

In the lawsuit, MALDEF said Mr. Barnett approached the group as the immigrants moved through his property, and that he was carrying a pistol and threatening them in English and Spanish. At one point, it said, Mr. Barnett's dog barked at several of the women and he yelled at them in Spanish, "My dog is hungry and he's hungry for buttocks."

The lawsuit said he then called his wife and two Border Patrol agents arrived at the site. It also said Mr. Barnett acknowledged that he had turned over 12,000 illegal immigrants to the Border Patrol since 1998.

In March, U.S. District Judge John Roll rejected a motion by Mr. Barnett to have the charges dropped, ruling there was sufficient evidence to allow the matter to be presented to a jury. Mr. Barnett's attorney, David Hardy, had argued that illegal immigrants did not have the same rights as U.S. citizens.

Mr. Barnett told The Washington Times in a 2002 interview that he began rounding up illegal immigrants after they started to vandalize his property, northeast of Douglas along Arizona Highway 80. He said the immigrants tore up water pumps, killed calves, destroyed fences and gates, stole trucks and broke into his home.

Some of his cattle died from ingesting the plastic bottles left behind by the immigrants, he said, adding that he installed a faucet on an 8,000-gallon water tank so the immigrants would stop damaging the tank to get water.

Mr. Barnett said some of the ranch´s established immigrant trails were littered with trash 10 inches deep, including human waste, used toilet paper, soiled diapers, cigarette packs, clothes, backpacks, empty 1-gallon water bottles, chewing-gum wrappers and aluminum foil - which supposedly is used to pack the drugs the immigrant smugglers give their "clients" to keep them running.

He said he carried a pistol during his searches for the immigrants and had a rifle in his truck "for protection" against immigrant and drug smugglers, who often are armed.

ASSOCIATED PRESS DEFENDANT: Roger Barnett said he had turned over 12,000 illegal immigrants to the Border Patrol since 1998.

A former Cochise County sheriff´s deputy who later was successful in the towing and propane business, Mr. Barnett spent $30,000 on electronic sensors, which he has hidden along established trails on his ranch. He searches the ranch for illegal immigrants in a pickup truck, dressed in a green shirt and camouflage hat, with his handgun and rifle, high-powered binoculars and a walkie-talkie.

His sprawling ranch became an illegal-immigration highway when the Border Patrol diverted its attention to several border towns in an effort to take control of the established ports of entry. That effort moved the illegal immigrants to the remote areas of the border, including the Cross Rail Ranch.

"This is my land. I´m the victim here," Mr. Barnett said. "When someone´s home and loved ones are in jeopardy and the government seemingly can´t do anything about it, I feel justified in taking matters into my own hands. And I always watch my back."

So why doesn't the US protect our citizens from this?

    and

why doesn't the Federal Government make some of the richest multi-national corporations pay taxes?

The United States no longer has borders or the will to tax the richest partakers of our hegemony....and when we attempt to invest in our infrastructure the GOP become a group of traitors that look the other way when billions are given without oversight to top banks and call investing in our infrastructure senseless spending. I guess they will be retiring in Dubai, and don't give a shit about those who paid for their ticket!

are ya feeling lucky, well...are ya?

here is a great investment tip for a penny stock that will only go up up up. spend a few thousand now and it will be worth millions in just 10 or 15 years

    its called

    CERP

    CEREPLAST

they make all types of plastic from plant cellulose and are about to be featured on the Discovery Channel - get the stock while its still worth pennies. all of their products are biodegradable and they make plastics that are hard enough to make vehicles with. the sky is the limit when it comes to this type of tech ;]

    dearest mixednuts,

I guess that is what many believe the solution is, but personally, I feel as though the border is a sham and it should be open from Canada to Brazil. Our current strategy is inhumane. and, I think that as long as there are borders, they should be secured and our citizenry supported in fending off the illegals! I hate the double talk and the confusion that led to those border agents being incarcerated, I feel as though we have a full blown range war going on and the Bush Doctrine betrayed everyone!

I find Mexico to be very frightening as well, not wanting to go down there ever again after the first time. why do you suppose it is such a no-mans land? maybe bringing it into the US would help it - to tell you the truth, under the Bush admin, the US was very much like Mexico and Canada was looking better everyday!

I say open it up and let the Wild West begin. But, many multi-nationals use the arbitrary border we have to exploit tax law and Mexicans. They open up these border factories and don't even pay a Mexican a living wage, they live in very bad squalid conditions and work for monsters that think they can do whatever they want cus its Mexico. I'm all for ending the border thing cus it creates more problems than it solves. but, I totally share your outrage over the injustice done to this rancher and his family, and to the two border agents.

    lies, lies lies

our economy is voodoo and there are few who even understand how it works

    why?

because they do not realize that the dominant paradigm is corrupt....that which everyone believes in only creates collapsing economy and society. They fight between the left and the right about who is to blame, should we be right handed or left handed, or should we stop slapping our face with both hands and get down to what is real.

the Democrats are no better than the Republicans, except that they lie more intelligently. Neither one of these two have any solutions.

    My solution?

    1. end the IRS and institute a hefty consumption tax

     2. initiate a 4 day work week

    3. take all of the 'failed assets' across the country and turn them into 'half-way houses' for the non-violent prison inmates that get released in waves. These inmates can then be enlisted to do local infrastructure projects like the CB's did in the last depression.

    4. bring back all military personnel from around the world

    5. give 2.5 acres to any citizen that wishes to operate a small family farm

    6. give states funding for local farmers markets and processing facilities

    7. let the gov take the empty houses that the banks are sitting on (banks that took TARP) and let HUD give these houses to the homeless as a subsidized lease/option to buy this 'failed asset'

    8. change the banking laws so that 10% banking is no longer legal. require banks to have at least 33% liquidity

    9. tax vice: drugs and prostitution

    10. bring the 'under the table' jobs into the fold by ending the IRS and instituting the consumption tax.

    11. give all vets full ride college scholarships

    12. disband the DEA

    13. eliminate the HMO middlemen in our health industry

    14. make steroids in milk illegal

    16. legalize alternative medicine

this is my initial wish list

these actions would redesign our society in a way that will help the least amongst us. If we care for our own, we will become the light on the hill that all nations need. love to you mixed nuts. thanks for your presence

the Federal Reserve is a joke

most Americans don't have a clue that this is private

and they thought Greenspan was our guy. nope, he was someone else's Jimminy Cricket!

I'm surprised if Alan can actually go out among the people these days....isn't there a lynch mob looking for him? and how the hell did he ever get Andrea Mitchell?

no blunts for me my friend

tobacco makes me hyperventilate - accidentally took a puff from a blunt once and thought i might have a heart attack for goodness sakes

I'm a real light weight when it comes to drugs

the herb, is my medicine and we grow the best legally...we call it 'guilt free' ganja bc we do not have to look over our shoulders or feel like criminals just cus we prefer the herb to any or all other drugs - INCLUDING ANTIBIOTICS

I will take this moment to warn any unsuspecting readers about the pandemic that has been created as a result of 70 years of mass antibiotic treatments. we are less healthy and there are now antibiotic strains of staph that are resistant to antibiotic treatment and this is MARSDA - the flesh eating disease that killed that perfectly healthy Brazillian beauty queen at the age of 20

anyway, hate being a fear monger, but.... peops need to educate themselves much better if they wish to survive the propaganda of the AMA (American Medical Association).

anyway mixednuts....today is beautiful and I'm starting an alcohol fast after i drink this last ale in the fridge....i will toast you my friend

    mahalo for your aloha

oh A-rod is so very cute when he is trying not to cry

    wow,

what a moment when he was trying to thank his team-mates. He couldn't talk, he was so close to out and out bawling. now, he just admitted that he had injected the substance that his cousin gave him back in the day. We have a whole nation on drugs and we have a war on drugs that doesn't do any good. I feel like I live in a looney bin for a nation. They tried to calm down a manic chimpanzee with anti-depressants and then the chimp ripped someones face off! Got Zoloft? give it to your pet chimp. lets put it in the kool-aid for goodness sakes!

    steroid abuse is a joke

all the nations kids are on Bovine Growth Hormone and they rake these guys over the coals! Bill Maher said some great stuff recently and I am loving the wave of comediennes that put shit into perspective. like you mixed nuts!
