According to the Associated Press, a Texas woman who caused her lover's shooting death by falsely crying rape was convicted Friday [May 2, 2008] of involuntary manslaughter.  The District Attorney originally charged the husband with the crime, however the District Attorney dropped the murder charge and decided to charge the woman with involuntary manslaughter.  Of course all these folks are black. 

What gets me about this is that, everyone who found their spouse fucking someone else and killed (spouse and/or lover,) has been charged with manslaughter.  This husband gets to kill because his wife, who is no longer in danger, cries rape.  I don’t get it

The facts show that in late 2006, Darrell Roberson came home from a late-night card game to find his scantily clad wife with another man in a pickup truck in the driveway. Tracy Roberson was with her lover but cried rape, and her husband fired four shots into the truck as Devin LaSalle drove off, killing him.

The alleged rapist was leaving, driving off without the wife and the husband gets a free kill.

But prosecutors placed all the blame on Tracy Roberson, showing evidence of the affair with LaSalle, 32, and a text message in which she invited him to her house that evening.

Now don’t get me wrong, I believe the woman should be punished but I don’t get how the husband gets away with murder. It just doesn’t seem reasonable to me that you can kill someone who is fleeing.

So what do you think?  Should the husband have been charged?  Would it make a difference if you knew he had called his home over 20 times that evening and was told that “mom is outside in a car?”
